When choosing a location always keep in mind that one day you may want to sell the property you intend to buy now. Hence, a good location will always be very important.

Generally, this depends on your personal circumstances. In any case you should secure sufficient funds to enter into a property buying transaction. You may have to consider taking a mortgage, a bridging loan from a bank or perhaps first sell your property – or at least have a firm buyer who is committed and paid you a deposit.

That way even if they pull out of buying your property and you commit to buying yours, you may not end up out of pocket as much. You should at least have a good idea of your property’s value by marketing it and have an idea of the time frame you should expect it would take to sale it. Also, please keep in mind that staged payments might also be possible to arrange so that you may have additional time needed to provide the funds.

There is really no rule and it all depends on circumstances – as few or as many as you feel necessary. You should never feel pressured either way. Never the less, as there are many different properties on the market and Costa Blanca and Costa Calida are very popular destinations, you should be well advised to certainly view few before making a decision. It could be more, though in reality usually less – it all depends on many factors, such as, Spanish property market conditions, vendor’s circumstances, what is included in the price and of course how much you really want a particular property.

The vendor would always want to achieve as much as possible and the buyer to pay as less as possible. The reality is negotiated always somewhere in the middle. In respect to new build properties, there are no negotiations on the price – it is the same to everyone. At SUN SEA LIFE as Independent Property Advisers we are not influenced by any developer or provider and effectively mediate between the two parties and are often able to negotiate extras to be included in the price of a new build (e.g., parking place, storage room or perhaps air condition unit etc.) So, this can a clearly benefit you!

For a resale property this is not mandatory but many buyers prefer a peace of mind and ask us to assist. Having an independent property inspection should be done by a qualified surveyor and in Spain this means an architect. As independent property advisers SUN SEA LIFE will assist by putting you in contact with a professional and authorised architect, that would be the most cost effective. Just make sure you are firmly committed to buy a particular property before you engage a surveyor. If you are buying a brand-new build property (never lived in) from a developer, your purchase will be guaranteed (backed up by an obligatory Spanish Government legislation) valid for 10 years.

Furthermore, all reputable new build development companies we work with, are backed up by a bank guarantee, which is an additional safeguard against any payments you make to the developer.

Once you locate the area (in either Costa Blanca or Costa Calida) and a property you wish to purchase (be it resale or new build), in Spain you would be asked to pay a reservation fee so that the property is reserved specifically for you and taken off the market, not shown to anyone else. The amount depends on the price of the property and market conditions. Usually, a resale reservation fee ranges between € 3.000 and € 6.000 but may be higher, befitting the property price.

Some vendors may prefer a straight down deposit which would be 10% of the negotiated price. In case of resale property, a reservation fee or a deposit should be paid in to you lawyer’s client holding account. After your lawyer has gathered all the necessary legal information and due diligence checks on the property and its ownership, the deposit will be transferred to the vendor or their legal representative. In the case of a new build property, this would be paid into developer’s client holding account. This is done either via bank transfer or via a CC payment transaction. In either case, a payment receipt and a pre-contract would be issued.

Once a reservation fee and/or a deposit are paid, the time remaining is used by your legal representative (lawyer or accountant) to liaison with the vendor’s or developer’s legal representative to gather any further necessary information, make a final contract that both parties will sign and arrange for the final, remaining payment and completion date at the public notary office.

The common denominator for all of them is that they are well established, they do not charge extortionate fees (either a fixed fee or a percentage) and we are confident to recommend them.

A SUN SEA LIFE Independent Property Adviser will always explain clearly the whole buying process before you enter deep into any transaction. If, after paying a reservation fee you or the vendor have a change of mind, even though there are no legal or fiscal issues with the property or the ownership, you may be refunded with in a “good will period” of usually 7 days.

Once the Sales Contract is signed by both sides and the 10% deposit (or any others amount you may agree to) is paid and before the completion date and any final payments made, you decide to back out, then you will forfeit (lose) the whole amount. Should the vendor / developer change their mind, they will have to repay your paid funds and an equivalent indemnity. In any case the Contract will clearly stipulate all the Terms and Condition.

In Spain, agents commission fees vary depending on the area. They may be either a pre agreed fixed fee commission or a percentage of the agreed sales price. Most commonly commission is included in the price of the property.

However, in some regions of Spain, it may be split proportionally between the two parties. On occasion the agent, if a mediator between two or more parties, may also charge the buyer a brokerage fee.
